This Rental Agreement and Release of Liability ("Agreement") is entered into between Fluffy Rides LLC ("Company") and the undersigned individual ("Lessee") including but not limited to minors under the supervision of lessee for the purpose of utilizing the facilities, premises and Electric Animal Scooters managed by the Company with the location at 11750 Fair Oaks Mall, Virginia, VA, USA. By signing this Agreement, lessee acknowledges and agrees to the following terms and conditions:

Lessee under 4 ft. in height must be accompanied on all rides by an adult

Max weight is 250 lbs. per ride and with no more than two riders at any time

Food and drinks are not allowed while riding

Lessee must remain within designated riding route

Lessee is not allowed to go inside the stores, food court, elevators, escalators, stairs or outside the mall

Bumping into persons or other riders is not permitted

All minor riders must have adult supervision of the lessee while riding

Helmets and other safety gear are strongly recommended for all riders

Lessee agrees to take full responsibility for the Electric Animal Scooters against theft or unauthorized use during the term of the rental

Lessee authorizes Fluffy Rides LLC to charge late fees to the payment method on file for any delay beyond the initial rental period which will result in an additional fee of $1 per minute.

Lessee is responsible for any damage beyond normal wear and tear. The Company may charge repair costs up to the full replacement value of $1,000, at its sole discretion.
In consideration of the Company allowing the undersigned lessee to make use of the facilities, premises, and Electric Animal Scooters for the relevant purpose, the undersigned lessee agrees to voluntarily assume the foreseeable and unforeseeable risk of personal injuries related to the activity, and agrees to waive any right to reimbursement, release, discharge, and hold harmless the Company, its owner(s) and employee free from any and all abilities, claims, cause of action, damages, or losses, which may be incurred by the undersigned in using said premises, properties and or facilities, and which may arise from any reason, specifically including, but not limited to, any negligence on the part of the owners, its employees, or any losses arising from mechanical failures, improper use, accidents, theft or for any other reason whatsoever.
Lessee agrees to indemnify, defend, and hold harmless Fluffy Rides LLC, its officers, directors, employees, agents, affiliates, and any third parties (including mall owners and bystanders) from and against any and all claims, demands, liabilities, damages, costs, and expenses (including reasonable
attorney’s fees) arising out of or related to the use or operation of the Electric Animal Scooters by the Lessee or any minor under their supervision, including claims arising from the negligence of Fluffy Rides LLC."
This Agreement shall be binding upon the parties, their respective heirs, representatives, successors, and assigns. Any alteration, modification, or amendment to this Agreement shall not be considered as valid unless otherwise written and signed by both parties.
This Agreement shall be governed by and interpreted in accordance with the laws of the state of Virginia. By signing this Agreement, Lessee acknowledges and agrees to abide by the following terms and conditions during the rental and operation of the Electric Animal Scooters.
